Effective Date: June 24, 2021 This document describes the privacy policies practiced by Institute of Exercise Introduction MYCPR NOW recognizes that protection of Your privacy is important. This document outlines the personal information (as identified below) MYCPR NOW receives and collect when You use the Site. Personal Information MYCPR NOW does not collect any personal information from You unless You voluntarily provide it to MYCPR NOW or otherwise consent to providing such information. If You purchase products or services through the Site, You may be asked to provide MYCPR NOW with certain personal information, such as Your first name, last name, physical address, and email address. Other information may include information regarding Your education and experience background and areas of interests. Only individuals who are 18 years of age or older are authorized to use the Site, and therefore MYCPR NOW does not knowingly collect any personal information from Users under the age of 18. In connection with Your purchase of any products or services from MYCPR NOW, You may provide additional personal information required for payment purposes, such as bank account numbers, credit card or debit card numbers, account details, ACH information, and similar data. MYCPR NOW may utilize a third-party payment processing provider, in which case such information will be provided to such third party. If You subscribe to the MYCPR NOW newsletter, You will provide Your e-mail address, and by doing so You consent to Your receipt of commercial solicitations and advertising from MYCPR NOW. Usage Information Like many websites, MYCPR NOW uses automatic data collection technology when You visit the Site to record information that identifies Your computer, to track Your use of the Site, and to collect certain basic information about You and Your surfing habits. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of website users. Disclosure of Personal Information to Third Parties MYCPR NOW does not disclose Your personal information to third parties for their direct marketing purposes. However, third parties may advertise on the Site (including through banner ads) and, if You opt in, MYCPR NOW may provide Your personal information with third party marketing partners and affiliates.
MYCPR NOW, like many businesses, may sometimes hire other companies to perform certain business-related functions. Examples include mailing information, marketing MYCPR NOW products and services, maintaining databases, hosting services, and processing payments. When MYCPR NOW employs another company to perform a function of this nature, MYCPR NOW provides them with the information that they need to perform their specific function, which may include personal information. MYCPR NOW is not liable under any circumstances if there is a security breach on any third-party site, including, but not limited to, any third-party payment processor to which You provide payment information. Note: If You opt out from receiving further promotional emails from MYCPR NOW, MYCPR NOW will not share Your email address with any third parties, including our affiliates. Shopify and Paypal MYCPR NOW uses Shopify and Paypal for payment processing. MYCPR NOW does not store or collect Your payment card details. That information is provided directly to third-party payment processors whose use of Your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. Important Notice to Users Outside the U.S. The Site and the Services are operated in the United States, and is intended only for use by those located within the United States. Governing Jurisdiction of the Missouri, USA Courts The Site is operated and provided in the State of Missouri, USA. Arbitration and Class Action Waiver You agree to binding individual arbitration before the American Arbitration Association (“AAA”) under the Federal Arbitration Act (“FAA”), and You agree not to sue in court in front of a judge or jury. You further agree that You may bring claims for violation of this Privacy Policy or related in any manner to Your use of the Site, any MYCPR NOW products or services purchased by You, or Your personal information in Your individual capacity and not as a plaintiff or class member in any purported class or representative action. Unless both parties agree, the arbiter or judge may consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding. Waiver of Jury Trial In the event that a dispute between the parties is presented to a court, each party hereby waives any right to trial by jury in any claim, action, proceeding or counterclaim by either party against the other pertaining to any matters arising out of or in any way connected with this Privacy Policy, Your personal information, or the relationship of the parties. Changes to This Privacy Policy This Privacy Policy is effective as of the date stated at the top of this Privacy Policy.
